We have prepared this Privacy Policy to describe to you our practices regarding Personal Information (defined below) we collect from Popbox registered users (“User(s),” “you,” “your(s)”) through the Popbox app (the “App”). The Privacy Policy does not apply to information we may obtain from other sources or to information collected by third parties, including third parties whose sites, services, or applications you may access through the App. This Privacy Policy is incorporated into and forms a part of our Terms of Service.

When you open the App and/or shop using the App, we also collect information about your shopping activities inside the App, such as the time, date and duration of your use of the App, your search queries, items you viewed or put into or removed from your shopping cart, and items you bookmarked.
To make our App more useful, our servers (which may be hosted by a third-party service provider) may also collect “log data,” which may include technical information about the device you use to access the app.
We use this information to authenticate your account, execute your orders, and improve the quality of our App and your user experience.
You have choices regarding the collection, use, and sharing of your Personal Information. Except as required for Popbox to maintain and communicate with you regarding your Popbox account and to facilitate transactions you request, you may to choose what Personal Information we collect and store and how we use it. You may choose to provide us with as much or as little Personal Information as you wish and to prevent us from sharing your Personal Information with third parties. However, in order to provide the App and Popbox services to you, and to complete your shopping transactions, we must be permitted to collect and use the Personal Information required to do so.
As long as you maintain an Popbox account, we may communicate with you about your account and about changes to our Terms of Service or this Privacy Policy. If we send you communications about new or upcoming Popbox services, or other promotional materials and offers, you may opt-out of receiving further communications by contacting us directly using the information below.
Popbox’s services, as well as our operations, are offered in the United States. Your Personal Information and Popbox account information may be processed in the country in which it was collected and will be transferred from your country to the United States. Your decision to provide such information to us, or to allow us to collect such information through the App constitutes your informed consent to this data transfer and to our collection and use of such information in accordance with this Privacy Policy and our Terms of Service. For information that we do not require in order to provide you with the App and your Popbox account, you may withdraw your consent at any time by exercising the choices described above. For information that we do require in order to provide you with the App and your Popbox account, you may withdraw your consent at any time by terminating your membership and asking us to delete your account and profile.
You may have additional rights under applicable data protection laws. For example, you may have the right to lodge a complaint with a data protection authority in your country. You may also have the right to request access to and rectification or erasure of your personal information or restriction of processing of your personal information. You may have the right to object to processing of your personal information, as well as the rights relating to data portability, correction, amendment or deletion of personal information that is inaccurate or that has been processed in violation of this Privacy Policy. Popbox respects the privacy rights of all of our users, and we are committed to complying with data protection laws to the extent they apply to us. Upon request to us at the address set forth below, Members may obtain confirmation from us as to whether we possess and are processing their personal information. Please allow us a reasonable time to respond to such requests.
We do not sell, trade, or otherwise transfer your Personal Information to advertising networks. However, Anonymous Data and/or Personal Information may be provided to other parties as described below.
THIRD-PARTY PROVIDERS AND PARTNERS: We may provide access to, links to or information about third-party products or services via our App. If you interact with these third parties, they may collect Personal Information that you choose to share with them. These third parties have separate and independent privacy policies and terms of use, and we have no responsibility or liability for the content and activities of such third parties.
Popbox may share, or you may be prompted to share directly, your applicable Personal Information with third-party providers and partners we work with in connection with the activities described in “Use of Your Information,” above. These third parties are contractually required not to use your Personal Information other than to provide the service requested by you or Popbox. In particular, we work with third parties to:
AFFILIATES AND ACQUISITIONS: We may share some or all of your Personal Information with any subsidiaries, joint ventures, or other companies under common control with us (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires the Popbox business or our assets, through any means, that company will possess the Personal Information collected by us and will assume our rights and obligations regarding your Personal Information as described in this Privacy Policy.
LAW ENFORCEMENT: Popbox may disclose Personal Information if it believes in good faith that such disclosure is necessary:
Popbox is committed to protecting the security of your Personal Information. We have implemented and maintain commercially reasonable and appropriate security technologies and procedures to help protect your Personal Information from accidental loss and from unauthorized access, use, alteration or disclosure. You are responsible for keeping your Popbox account login information confidential. By using the App, you acknowledge that No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we use reasonable efforts to protect your Personal Information, we cannot guarantee its absolute security.
Only persons of the legal age required to enter into contracts have permission to become Popbox Members. We do not target, and the App is not intended for use by, anyone under the age of 13. We do not knowingly collect personally identifiable information from children. If you are a parent or guardian and you learn that your child has provided us with Personal Information, please contact us. While we are not under any obligation to actively monitor our App for such information, if we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we will do our best to remove that information from our servers in a timely manner.
You may access, change or delete any of your Personal Information in your Popbox account at any time by using the tools available in the App or by contacting us at the email address below. If you wish to delete your profile completely you may do so by contacting us and requesting that your account be deleted. However, please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements) in order to comply with the law, enforce the App policies, or protect our or others’ rights, property, or safety. We store the information we collect about you for as long as is necessary for the purpose(s) for which we originally collected it, or for other legitimate business purposes, such as for fraud prevention or similar purposes, for backup or archival purposes, to analyze and improve the App, and to meet our legal, regulatory, or other compliance obligations. When we delete any information, it will promptly be deleted from the active database, but may remain in our archives until deleted in the ordinary course.
Popbox does not track its users across third-party websites, and therefore we do not respond to Do Not Track signals sent by your browser or mobile application.
California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their Personal Information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. We do not share Personal Information for direct marketing purposes.
Similarly, for purposes of the California Consumer Privacy Act, even though the act does not currently apply to us, we do not sell Personal Information, and we do not use, share or retain personal information other than as set forth in this Privacy Policy and our Terms of Service.
We may update this Privacy Policy from time to time. If you are an Popbox registered user, we will inform you of any material changes, either through the App or by email. Your continued use of the App constitutes your agreement with the existing and updated Privacy Policy.
It is important to note that any changes to this Privacy Policy may affect our use of Personal Information that you have provided to us prior to any such changes. If you do not wish to permit changes in our use of your Personal Information, you must notify us that you wish to deactivate and delete your Popbox account. Continued use of our App, following the posting such changes on this page, shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
